Personalberater werden von Unternehmen beauftragt, die Unterst?tzung bei der Suche und Auswahl von Kandidaten f?r wichtige F?hrungspositionen ben?tigen. Im Folgenden wird allein die Methode der Direktansprache wettbewerbsrechtlich analysiert, da die Suche per Zeitungsannonce oder Internet eine Initiative des wechselwilligen Arbeitnehmers erfordert, weshalb sich naturgem?? keine direkten wettbewerbsrechtlichen Verst??e der Personalberatung ergeben k?nnen. Unter der Direktansprache, dem sog. 'Headhunting' ist die aktive Kontaktaufnahme eines Beraters (Headhunters) mit potentiellen Kandidaten zu verstehen, deren Wechselwilligkeit des Arbeitsplatzes bis zu diesem Zeitpunkt noch nicht bekannt ist. Angesprochen werden ?berwiegend F?hrungskr?fte, die dem Anforderungsprofil einer vakanten Position entsprechen und die sich zum Zeitpunkt der Kontaktaufnahme noch in einem Arbeitsverh?ltnis befinden1. Eine Abwerbung mittels Verleitung zur ordnungsgem??en Vertragsaufl?sung, also unter Einhaltung gesetzlicher K?ndigungsfristen ist grunds?tzlich zul?ssig2. Eine Wettbewerbswidrigkeit kann sich nur aus besonderen Begleitumst?nden ergeben, die die Abwerbung im konkreten Fall als unlauter oder sittenwidrig erscheinen lassen. Daf?r gen?gt es nicht, dass eine fremde Arbeitskraft durch das Versprechen eines h?heren Lohns oder besserer Arbeitsbedingungen zur K?ndigung veranlasst wird. In einer freien Marktwirtschaft, in der qualifizierte Mitarbeiter einen Erfolgs- und Wettbewerbsfaktor darstellen, muss jeder Unternehmer damit rechnen, dass seine Besch?ftigten k?ndigen, wenn ihnen bessere Bedingungen geboten werden. Insbesondere auch bei Schl?sselkr?ften ( Spezialisten ) ist eine auf ordnungsgem??e L?sung des Vertragsverh?ltnisses gerichtete Abwerbung nicht unlauter. Auch eine planm??ige Vorgehensweise ist f?r sich allein kein besonderer Umstand, der die Sittenwidrigkeit einer Abwerbung i.S.d. § 1 UWG begr?ndet.3 Unter 'planm??ig' versteht der BGH, ein auf Dauer angelegtes, zielbewusstes Vorgehen des Abwerbenden. The typical response of constitutional and international lawyers as well as political theorists has been to extend domestic concepts - especially constitutionalism - beyond the state. Yet as this book argues, proposals for postnational constitutionalism not only fail to provide a plausible account of the changing shape of postnational law but also fall short as a normative vision. They either dilute constitutionalism's origins and appeal to 'fit' the postnational space; or they create tensions with the radical diversity of postnational society. This book explores an alternative, pluralist vision of postnational law. Pluralism does not rely on an overarching legal framework but is characterized by the heterarchical interaction of various suborders of different levels - an interaction that is governed by a multiplicity of conflict rules whose mutual relationship remains legally open. A pluralist model can account for the fragmented structure of the European and global legal orders and it reflects the competing (and often equally legitimate) claims for control of postnational politics. However, it typically provokes concerns about stability, power, and the rule of law. This book analyzes the promise and problems of pluralism through a theoretical enquiry and empirical research on major global governance regimes, including the European human rights regime, the contestation around UN sanctions and human rights, and the structure of global risk regulation. The empirical research reveals how prevalent pluralist structures are in postnational law and what advantages they possess over constitutionalist models.  | ＜p＞This volume explores the complex and contradictory ways in which the cultural, scientific and political myth of whiteness has influenced identities, self-perceptions and the process of integration of Nordic immigrants into multicultural and racially segregated American society in the nineteenth and twentieth centuries. In deploying central insights from whiteness studies, postcolonial feminist and intersectionality theories, it shows that Nordic immigrants - Danes, Swedes, Finns, Norwegians and S?mi - contributed to and challenged American racism and white identity. A diverse group of immigrants, they could proclaim themselves ‘hyper-white’ and ‘better citizens than anybody else’, including Anglo-Saxons, thus taking for granted the racial bias of American citizenship and ownership rights, yet there were also various, unexpected intersections of whiteness with ethnicity, regional belonging, gender, sexuality, and political views. ‘Nordic whiteness’, then, was not a monolithic notion in the USA and could be challenged by other identities, which could even turn white Nordic immigrants into marginalised figures.
