 | ＜p＞Wissenschaftlicher Aufsatz aus dem Jahr 2010 im Fachbereich Jura - Andere Rechtssysteme, Rechtsvergleichung, , Sprache: Deutsch, Abstract: Die vorliegende Arbeit besch?ftigt sich einem schon aus dem r?mischen Recht bekannten Rechtsinstitut n?her besch?ftigen - der Erwachsenenadoption: Die Erwachsenenadoption weicht insofern von den allgemeinen gesellschaftlichen Vorstellungen vom Wesen einer Adoption ab, als das vollj?hrige Kind in der Regel sein Leben selbst zu gestalten vermag und nicht - wie das minderj?hrige Kind - auf Schutz, F?rsorge und Erziehung durch Ersatzeltern angewiesen ist. Trotzdem ist sie in ?sterreich - im Vergleich zu vielen anderen Staaten - erlaubt und es werden auch st?ndig vollj?hrige Personen an Kindes statt angenommen. In dieser Arbeit sollen sowohl die ?sterreichische Rechtslage als auch die deutsche Rechtslage in Bezug auf das Rechtsinstitut der Erwachsenenadoption detailliert behandelt werden, um so Unterschiede zwischen den beiden L?ndern aufzeigen zu k?nnen. Es wird jeweils auf Voraussetzungen, Verfahren, Wirkungen und auch die Beendigungsgr?nde eingegangen. Herausgearbeitet werden Unterschiede und Gemeinsamkeiten der Erwachsenenadoption dann in einem zusammenfassenden Kapitel unter verschiedenen rechtlichen Gesichtspunkten. Da in der Praxis meist ausl?ndische Staatsb?rger adoptiert werden, besch?ftigt sich diese Arbeit innerhalb des zweiten Teils zus?tzlich mit den Auslandssachverhalten. Ziel dieser Arbeit ist die Darstellung der Rechtslage was die betreffend die Erwachsenenadoption in zwei europ?ischen Staaten. Nach einer Abhandlung der Erwachsenenadoption im geltenden ?sterreichischen Recht soll - um einen direkten Vergleich zu erm?glichen - die Erwachsenenadoption im geltenden deutschen Recht ausf?hrlich thematisiert werden. Der Vollst?ndigkeit halber wird auch auf das Rechtsinstitut in anderen ausgew?hlten europ?ischen L?ndern eingegangen. In einem letzten Kapitel werden die Erkenntnisse ?berblicksartig zusammengefasst.
